Welcome to Remotsify. These Terms and Conditions (“Terms”) govern your use of the Remotsify website located at https://remotsify.com (the “Site”) and the remote recruitment, HR support, executive search, and payroll services provided by Remotsify (“we,” “our,” or “us”).

By accessing our Site, registering for an account, submitting your resume, or engaging our recruitment services, you (“User”, “Candidate”, or “Client”) agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Site or Services.

1. Definitions

  • “Services” refers to the remote recruitment, executive search, contract and compliance management, interview coaching, profile optimization, global payroll, and ongoing HR support provided by Remotsify.
  • “Candidate” refers to any individual who submits their resume, applies for an open position, or utilizes our profile optimization and interview coaching services.
  • “Client” refers to partner companies or businesses that engage Remotsify to recruit talent, manage payroll, or provide HR solutions.
  • “User” refers to any visitor to the Site, including both Candidates and Clients.

2. Eligibility and Registration

  • Age Requirement: You must be at least 18 years old to use our Services or submit an application.
  • Account Accuracy: When applying for a role or registering as a Client, you agree to provide accurate, current, and complete information. Candidates must ensure that their resumes, portfolios, and employment history are completely truthful.
  • Account Security: You are responsible for maintaining the confidentiality of any account credentials provided to you and for all activities that occur under your account.

3. Services for Candidates

  • No Guarantee of Employment: While Remotsify evaluates professionals and connects them with global companies, submitting a resume or completing our evaluation process does not guarantee job placement, interviews, or offers of employment.
  • Background Checks: By submitting an application, Candidates acknowledge that Remotsify or our partner Clients may conduct reference checks, background checks, and verification of qualifications.
  • Free Service for Candidates: Our core job placement services are generally free for Candidates. Any premium services (like advanced profile optimization or coaching) will be clearly outlined with their respective fees before you agree to them.

4. Services for Clients (Employers)

  • Service Agreements: Corporate Clients engaging Remotsify for talent recruitment, executive search, or payroll services will be required to sign a separate, detailed Service Level Agreement (SLA) or Master Services Agreement (MSA). In the event of a conflict between these Site Terms and the MSA, the MSA will prevail.
  • Hiring Decisions: Remotsify presents qualified candidates, but the final hiring decision and employment contract rest entirely with the Client. Remotsify is not a co-employer unless explicitly stated under a specialized global payroll or Employer of Record (EOR) contract.

5. Acceptable Use of the Site

Users agree not to:

  • Use the Site for any unlawful purpose or to solicit others to perform unlawful acts.
  • Submit false, inaccurate, or misleading information (including fake job postings or forged resumes).
  • Attempt to bypass or breach any security mechanisms on the Site.
  • Use automated systems (bots, scrapers) to extract data, job postings, or user information from the Site.
  • Upload any code, viruses, or malware that may disrupt the functionality of the Site.

6. Intellectual Property Rights

All content on the Remotsify website—including text, graphics, logos, images, software, and videos—is the property of Remotsify or its content suppliers and is protected by international copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of our Site without explicit written permission.

7. Confidentiality and Data Privacy

  • Privacy Policy: Your use of our Site is also governed by our Privacy Policy, which details how we collect, use, and protect your personal data (including resumes and company data).
  • Confidential Information: Candidates may be exposed to confidential information about Client companies during the interview process. Candidates agree not to disclose any sensitive business information obtained during these processes.

8. Disclaimers

  • “As-Is” Basis: The Site and Services are provided on an “as is” and “as available” basis. Remotsify makes no warranties, expressed or implied, regarding the continuous availability or error-free operation of the Site.
  • Third-Party Links: Our Site may contain links to third-party websites (e.g., social media profiles like Facebook, Instagram, YouTube, TikTok). We do not control and are not responsible for the content or privacy practices of these external sites.

9. Limitation of Liability

To the fullest extent permitted by law, Remotsify, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages—including loss of profits, loss of data, or loss of employment opportunities—arising out of or related to your use of the Site, reliance on any information provided, or engagement in our recruitment process.

10. Indemnification

You agree to indemnify, defend, and hold harmless Remotsify from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your use of the Site, including but not limited to any fraudulent resume submissions or breaches of confidentiality.

11. Modifications to Terms

Remotsify reserves the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to this page. Your continued use of the Site after any modifications indicates your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Remotsify is officially headquartered, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the competent courts of that jurisdiction.
